Agency – Acts as a representative of many Artists and links the client to a selected Artist to hire.
Client – the client\customer, who hires the Artist and is responsible for paying for the act and the related expenses
Artist – Speaker or Performer responsible for providing the Act or Services.
Quotes and Artist availability will be produced for the client upon expression of interest advice from the client. Quotes are Valid for 7 days only.
A deposit is payable upon booking. For a client to secure the desired date of the Artist a 50% non-refundable deposit will be required, unless another deposit amount has been otherwise agreed to. An Artist is not considered booked unless a deposit has been paid. The payment of a deposit for an Artist will imply your acceptance of the advertised Terms & Conditions.
Balance of the fee to be paid within 30 days of appointment date.
Any expenses; parking, travel & accommodation, transfers or out of pocket expenses that are incurred by the Agency or Artist, relevant to the booking, are payable by the Client up to 7 days post event. The Entertainers will and supply an invoice to the Client.
4. CANCELLATION BY CLIENT
In the event of the client requiring to cancel performance\s,
A. More than 30 days notice to the engagement date – deposit is forfeited.
B. Less than 30 days notice to the engagement date – full agreed fee is payable
C. Any disbursements The Entertainers Australia have incurred, including flights, accommodation, transfer bookings which are not recoverable are also payable in addition to the cancellation fees
An email received by a client at The Entertainers Australia indicating the client’s intention to book will be classified as a Booking and these cancellation clauses will be executable.
5. CANCELLATION BY ARTIST
If for any reason the Artist is not able to perform due to illness, personal or other unforeseen circumstances, and the client is unable to transfer the Artist to another mutually accepted date, the Artist and agent will endeavour to find a replacement of similar calibre and rate. If the options offered are not suitable for the client, a full refund will be recompensed back to the client. The Entertainers Australia will not have any liability for expenses or losses incurred by the Client.
6. ADDITIONAL APPEARANCES
No additional appearances, outside of that specified in the Services Agreement, shall be planned by the Client, including but not limited to media, unless discussed and authorised with the Agent and then the Artist and their management.
7. AUTHORISED REPRESENTATIVE
The representative of the Client who signs this agreement declares that they are authorised to represent the Company\Client.
8. CHANGES TO AGREEMENT
Changes to the Services Agreement may only be made in writing. Changes made to the agreement without written confirmation and acknowledgement will not be recognised.
9. TRAVEL & ACCOMMODATION
The client will be responsible for payment of the Artist’s travel & accommodation expenses if the event is booked outside the Artist’s metropolitan location. The client will be required to organise the flights and accommodation. If the client is unable to organise the travel arrangements and requires The Entertainers Australia to organise, we are required to charge a 10% service or administration fee (of the expense cost total amount) to facilitate this.
Any authorised expenses The Entertainers Australia incur on behalf of the Client, are to be charged back to the Client
11. ARTIST FEE INCLUSIONS
Exclusive hire of the performance & Artist for the specified date and time.
12. ARTIST FEE EXCLUSIONS
The Artist’s fee quoted is exclusive of GST and does not include media commitments, production costs, meals & drinks as per rider, travel & accommodation & other related expenses.
13. PUBLIC LIABILITY
All Artists must have their own public liability insurance coverage. The Entertainers Australia will not be responsible or liable for the actions of the Artists (see Indemnity)
The client will be required to provide all technical equipment, staff, assistance and other details as outlined in the Artist’s production rider. Meals and drinks will be provided to the Artist for bookings over 4 hours. Proper dressing room facilities will be provided to the Artist. The exception will be where the performer or Artist has been asked to quote production costs in initial discussions and will be required to supply their own equipment.
All engagements booked will require a briefing call between the Client and the Artist. This will be organised as soon as possible after the booking has been made, or if specified by the Artist, a date that suits their schedule. All background information, runsheets, scripts, marketing information, notes and other information necessary for the Artist’s performance, must be provided to the Artist no later than 2 weeks prior to the event as a condition of this booking. Anything provided later than this date cannot guarantee the Artist’s full endorsement or their 100% commitment to the engagement.
The endorsement of products will need prior approval by the Artist or their Management and will need to be submitted in writing.
The Entertainers Australia does not permit the Client to record, broadcast, reproduce or duplicate any sound recording or video recording of the Artist’s performance unless authorised to do so by the Artist. The fee quoted is for Corporate speaking only and does not include any television, radio or other media appearances, print advertising or approval for usage online, through websites\social media, newsletters or other print media.
Immediate transmission to the audience to allow the audience to view the performance live is permissible.
If media appearances are required by any of the Artist’s submitted, a full media proposal will be required and pricing provided separately.
The Client agrees to indemnify and hold harmless the agent and its employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines and liabilities (including reasonable legal fees) caused by any negligent act or omission by the Client or its employees.
18. OUTDOOR EVENTS (and Force Majeure)
If for any reason outdoor performances need to be cancelled due to no fault of The Entertainers Australia, including bad storm weather conditions, no refund will be issued.
The client will be responsible, if possible, for providing indoor entertainment space for the performance to go ahead.
The Client and the Artist shall be excused from their obligations hereunder in the event of Force Majeure (including but not limited to fire, flood, earthquake or other natural disaster, war or riot). In this case, the client and the Artist may wish to discuss an alternative date.
The Entertainers Australia is an Agency that acts as a representative of the Artists and handles availabilities and bookings efficiently to service a Client. It cannot be held responsible for the statements and actions of the performer, and does not guarantee the quality of the performance of the Artist.
Please be aware that all quoted amounts are estimates only. Artists are secured only upon the payment of a deposit.
The Artist reserves the right to amend or alter his\her\their company’s terms and conditions in accordance with his\her\their company’s policies. The terms and conditions may be altered based on the client’s changes to their requirements.
